1. INTRODUCTION AND ACCEPTANCE

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sayvon Limited, a company incorporated in Hong Kong with company registration number 79635357, operating under the trade name "Anna for Creators" ("Company," "we," "us," or "our").

By accessing or using ANNA ("Service," "Platform," or "Software"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

IMPORTANT: By using our Service, you agree that we are providing a software tool only. We do not control how you use the Service, and you assume full responsibility for ensuring your use complies with all applicable laws, regulations, and third-party platform terms of service in your jurisdiction and the jurisdictions of any persons with whom you communicate using the Service.

2. DEFINITIONS

"Account" means your registered account with the Service.
"AI-Assisted Content" means any text, suggestions, or other content generated by the Service's artificial intelligence features.
"Assisted Mode" means the default operating mode where AI-generated messages are displayed for review but require manual action to send.
"Automated Mode" means the optional operating mode where AI-generated messages may be sent automatically without individual manual approval.
"Creator Platform" means OnlyFans or any other third-party platform integrated with the Service.
"Credits" means the units of value used to access Service features, purchased through our top-up system.
"User Content" means any content, data, or materials you upload, submit, or transmit through the Service.

3. ELIGIBILITY

B2B Only: Service is restricted to registered businesses and professional operators. Individual consumer accounts are not accepted.

Age Verification: All end-platform accounts must comply with 18+ KYC verification. The system inherits this verification layer from the integrated platform.

Prohibited Use: CSAM, non-consensual content, and illegal material are strictly prohibited. Violations will result in immediate account termination.

Data Protection: GDPR-compliant data handling. No cardholder data is stored on our servers; payment data is managed exclusively by the payment processor.

Governing Law: Terms are governed by Hong Kong law. Any disputes will be resolved by the Hong Kong International Arbitration Center.

4. SERVICE DESCRIPTION

4.1 Nature of the Service

ANNA is a software-as-a-service (SaaS) platform that provides AI-assisted tools for content creators and agencies to manage communications and content on Creator Platforms. The Service includes features such as AI-generated message suggestions, content management, and workflow automation.

4.2 Operating Modes

Assisted Mode (Default): AI-generated messages and content appear in the interface for your review. You must manually approve and send each message. This is the default mode for all users.
Automated Mode (Optional): Users may enable Automated Mode, which allows certain AI-generated messages to be sent automatically. Enabling Automated Mode requires acceptance of a separate Automation Consent Agreement, which transfers full responsibility for all automated communications to you.

4.3 Tool Provider Status

WE ARE A TOOL PROVIDER ONLY. The Company provides software tools. We do not control, direct, or supervise how you use these tools. You are the sole decision-maker regarding what content is created, sent, or published using the Service. We do not deploy the Service on your behalf—you deploy it for your own purposes.

5. USER RESPONSIBILITIES AND LEGAL COMPLIANCE

5.1 Your Responsibilities

You are solely responsible for:
  • All content created, sent, or published using the Service;
  • Ensuring your use of the Service complies with all applicable laws, regulations, and rules in your jurisdiction and the jurisdictions of persons with whom you communicate;
  • Compliance with all terms of service of Creator Platforms you use;
  • Obtaining any required consents, licenses, or permissions for your activities;
  • Maintaining the security of your account credentials;
  • Reviewing AI-generated content before sending or publishing.

5.2 Regulatory Compliance

NOTICE REGARDING AI DISCLOSURE LAWS: Various jurisdictions, including but not limited to certain U.S. states (California, Utah, Colorado, Maine, and others) and the European Union (under the EU AI Act), have enacted or are enacting laws that may require disclosure when individuals interact with AI systems or receive AI-generated content.

You acknowledge and agree that:

  • It is your sole responsibility to determine which laws apply to your use of the Service;
  • It is your sole responsibility to comply with any applicable disclosure requirements;
  • The Company does not provide legal advice and makes no representations about legal compliance;
  • You should consult with qualified legal counsel regarding your obligations.

6. PROHIBITED USES

You agree not to use the Service to:

  • Harass, abuse, stalk, or threaten any individual;
  • Engage in unauthorized spamming or mass messaging that violates platform terms;
  • Create, distribute, or manage content involving minors in any sexual or exploitative context;
  • Create, distribute, or manage non-consensual intimate imagery;
  • Engage in fraud, deception, or misrepresentation that causes financial harm to others;
  • Impersonate another creator or entity in a manner that causes harm or confusion;
  • Infringe upon intellectual property rights of third parties;
  • Violate the terms of service of any Creator Platform;
  • Engage in any activity that violates applicable laws or regulations;
  • Attempt to reverse engineer, decompile, or extract source code from the Service;
  • Interfere with or disrupt the integrity or performance of the Service.

Violation of these prohibitions may result in immediate account termination without refund and may be reported to relevant authorities.

7. INTELLECTUAL PROPERTY

7.1 Company IP

Sayvon Limited retains all right, title, and interest in and to the Service, including all software, algorithms, AI models, user interfaces, designs, trademarks, and other intellectual property. Nothing in these Terms transfers any ownership rights to you.

7.2 User Content

You retain ownership of User Content you upload to the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to process, transmit, and display your User Content solely as necessary to provide the Service to you. This license terminates when you delete your content or close your account.

7.3 AI-Generated Content

AI-Assisted Content generated by the Service based on your inputs may be used by you for your intended purposes. We make no representations regarding ownership or exclusive rights to AI-generated content.

7.4 No Training on User Content

We do not use your User Content to train our AI models for other users without your explicit, separate consent.

8. FEES AND PAYMENT

8.1 Credits System

Access to Service features requires Credits, which are purchased through our top-up system. Unused credits expire 60 days after purchase. Credits are consumed on a "First-In, First-Out" (FIFO) basis. Current pricing and credit allocations are available on our website. We reserve the right to modify pricing and credit values with reasonable notice.

8.2 Payment Processing

In limited circumstances, we may accept bank transfers for credit purchases. By making a purchase, you agree to the applicable payment processor's terms of service. We do not store complete payment card information.

8.3 Refund Policy

Due to the digital nature of our Service and the immediate access to digital credits upon purchase, refunds are governed by the terms below. We are committed to customer satisfaction. If you encounter any issue, please contact us at team@annaforcreators.com before initiating a dispute, and we will work to resolve it promptly.

Refunds available:
  • 48 hour window: You may request a full refund within 48 hours of purchase, provided no credits from that purchase have been consumed.
  • Unused credits: Unused credits are refundable on a pro-rata basis at any time upon written request.
  • Auto-refill charges: An auto-refill charge can be refunded within 24 hours if requested before any of those credits have been consumed.
  • Processing time: Approved refunds are issued to the original payment method within 5 business days.
Non-refundable:
  • Credits already consumed in active AI sessions are strictly non-refundable.
Free Trial: New users receive 700 free credits to test the Service.
The free trial requires no payment card and involves no charge.
It never converts into a paid subscription automatically: you will only ever be charged if you actively choose to purchase a credit pack.
Because the trial is free, no refund applies to it.
Consumer protection: We also honor any cooling-off or refund rights required by applicable local consumer protection law, where such rights exceed the terms above.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS WILL BE CORRECTED; (C) AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR EFFECTIVE; (D) USE OF THE SERVICE WILL COMPLY WITH ANY PARTICULAR LAWS OR REGULATIONS; (E) RESULTS OBTAINED FROM THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

WE ARE NOT A LAW FIRM AND DO NOT PROVIDE LEGAL ADVICE. ANY INFORMATION WE PROVIDE REGARDING LEGAL MATTERS IS FOR INFORMATIONAL PURPOSES ONLY.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAYVON LIMITED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sayvon Limited and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) User Content you create, upload, or transmit; (c) your violation of these Terms; (d) your violation of any applicable laws, regulations, or third-party rights; (e) any claims by third parties arising from your use of the Service; (f) your failure to comply with AI disclosure requirements or other regulatory obligations.

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

12.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with its rules. The arbitration shall be conducted in Hong Kong in English. The arbitrator's decision shall be final and binding.

12.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13. TERMINATION

You may terminate your account at any time through your account settings. Unused Credits are non-refundable upon termination. We may suspend or terminate your account immediately, without prior notice, for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, 11, 12, and 14 shall survive termination.

14. GENERAL PROVISIONS

Entire Agreement: These Terms, together with the Privacy Policy and Automation Consent Agreement (if applicable), constitute the entire agreement between you and the Company. 
Severability: If any provision is found unenforceable, the remaining provisions remain in effect. 
Amendments: We may modify these Terms at any time. Material changes will be posted on our website. Continued use constitutes acceptance.
